The Sun is to pay£10,000 damages and associated legal costs to Nottinghamshire Healthcare trust after the paper published an unauthorised picture of a Rampton Hospital patient.The photograph had originally been stolen from the patient's notes and was published without the consent of the patient or the hospital.Damages were awarded for breach of copyright, but included extra damages because 'of the flagrancy of the breach'.The Sun must also return all copies of the photo to the trust.Trust chief executive Jeremy Taylor said the award vindicated the action in bringing the case.'The trust as a whole hopes this sends a clear message to certain sections of the media that patient confidentiality is paramount and will be protected by any means available to us.'
