Basildon and Thurrock University Hospitals Foundation Trust is being prosecuted over the death of a severely disabled patient.

Kyle Flack, 20, from Stanford-le-Hope, was found dead at Basildon University Hospital, in Nethermayne, Basildon, on 12 October 2006. His head had become trapped in the rails around his bed.

Basildon and Thurrock University Hospitals Foundation Trust is being charged with breaching Section 3(1) of the Health and Safety at Work etc Act 1974.

The Health and Safety Executive alleges that the trust failed to ensure the patients in its care were not exposed to safety risks, namely the risks of injury or death should they become trapped by or entangled in rails, sides or other means used to prevent them falling from their beds.

The first hearing in the case will take place at Basildon Magistrates’ Court on Friday.
